Be aware that Cayman Airways is being required to provide certain information regarding passengers being transported to or from the United States in order to comply with the laws of the United States that have been put into place to identify potential security risks.
Under the regulations of the United States Customs Service (the "USCS"), Cayman Airways is required to allow USCS access to the travel reservation data of passengers flying on Cayman Airways flights to or from the United States. This reservation data includes information that you may consider personal, including your name, passport number, date of birth, contact information, ticketing data, travel itinerary, pricing, travelling companions, payment information and other information. In addition, hotel, and car rental reservations, connecting flight information, and information about special flight or ground services requests, may also be included in the data the PNR.
The USCS refers to this access as Passenger Name Record ("PNR") access. Access is supplied through the Cayman Airways reservation system. Cayman Airways is required to provide the USCS access to all PNR reservation data in accordance with the laws of the United States and in particular the "Aviation and Transportation Security Act" of 19 November 2001 as implemented in the USCS regulation issued June 25, 2002 and as codified at 19 CFR Part 122 (the "Regulation").
All airlines flying to or from the United States will be required to comply with the Regulation. Any airline that is not yet required to comply with the Regulation will soon be required. This is not an issue of voluntary compliance. Should Cayman Airways, or any airline, fail to comply with the Regulation they would be subject to sanctions, including possibly the denial of landing rights.
In addition to PNR data, Cayman Airways is also required, to send passport data of passengers, on flights to or from the United States, to the USCS and United States Immigration and Naturalization Service ("INS"). This information is provided pursuant to the "Advance Passenger Information System" (APIS). Under APIS, passport data of passengers is recorded electronically before the flight and sent immediately after flight departure. The information provided under the APIS system includes the name, date of birth, nationality, passport number and sex of each passenger.
By seeking the transportation services of Cayman Airways, and providing the data necessary for Cayman Airways for such transportation, you acknowledge an understanding that such data, which may consist of personal information, is subject to access by the USCS, the INS, and possibly other third parties through those agencies. Our provision of such data is a condition precedent to your transportation as a passenger by Cayman Airways. Your agreement to fly on a Cayman Airways flight constitutes your acknowledgment and acceptance of these legal requirements. Cayman Airways appreciates your understanding.
